Of course, with promise, there are always potential challenges to overcome. For example, the use of generative AI in discovery raises concerns about AI-generated summaries or analyses incorporating privileged information and potentially waiving privilege. AI models trained on privileged communications could inadvertently reveal protected information, leading to arguments that the use of these systems constitutes a waiver of privilege.
