I recently was interviewed on the “NeLI Pod” podcast by two eDiscovery veterans: Daniel Gold and Brandon Mack. Here are some highlights.
The “NeLI Pod” is the podcast of the National eDiscovery Leadership Institute (i.e., NeLI), which was formed in 2014 to provide high quality educational opportunities to judges and legal professionals specifically focused on electronically stored information (ESI) and to encourage cooperation between and among the bench and the bar. NeLI conducts an annual eDiscovery conference in Kansas City and this year’s conference is scheduled for September 11 and 12. They already have several speakers lined up for this year’s conference, including six judges!
The ”NeLI Pod” is a recurring podcast conducted by two veterans in eDiscovery: Daniel Gold, Principal at BDO, and Brandon Mack, Counsel, Director of Legal Technology and AI at Tanenholz & Marr. They’ve interviewed several eDiscovery thought leaders, including Judge Allison Goddard, Dr. Maura R. Grossman, Hon. Andrew J. Peck (ret.) & more!
Daniel, Brandon and I discussed several topics, including:
- The Evolution of Discovery to eDiscovery: The dramatic transformation of the legal discovery process over the last twenty years or so, moving from primarily paper-based document discovery to electronic evidence becoming the dominant source of evidence today, and whether we should drop the “e” now and just call it “discovery” – hint: there’s one big reason why we shouldn’t do that. 😉
- Technological Advancements and Their Impact on eDiscovery: The impact of significant technological changes, including the rise of the cloud, collaboration apps, mobile devices, and (of course!) the emergence of AI and generative AI.
- Challenges in Modern eDiscovery: Key challenges posed by new technologies and data sources, including the explosion of data volume, velocity and variety (i.e., “Big Data”), the complexity of ephemeral data and hyperlinked files, and the emerging threat of fabricated evidence, especially deepfakes.
- The Role of Courts and Case Law: The critical role of the judiciary in shaping eDiscovery practices and standards through case law.
- The Importance of Education and Competence: The need for legal and eDiscovery professionals to stay informed and develop technological competence to navigate the complex and ever-changing landscape.
The discussion was less like an interview and more like a discussion of important eDiscovery topics among three long-time professionals in the industry – a fun and informative discussion about today’s eDiscovery trends and best practices. Check out the interview here!
