Electronically Stored Information (ESI) has vastly increased discovery burdens on counsel for all sides, as parties are much more likely to have vast troves of documents to review for production, and to review once produced. In addition to official corporate documents, such as handbooks or investigation files, parties now typically seek social media, texts, and phone records from plaintiffs, supervisors, and other individuals in employment cases. How can counsel ensure that these records are properly preserved, extracted, reviewed and produced? When those loads of documents are dumped, how can receiving counsel efficiently find the relevant material?
