Sessions for the Electronic Discovery Institute (EDI)’s annual event – the EDI Summit 2024 start today! Here are notable sessions to check out!

EDI is a registered 501(c)(3) non-profit organization dedicated to education, leadership, service, advocacy and research at the intersection of law and technology. The EDI community comprises corporate counsel, private practitioners, judges, professors of law and science, consultants, technologists and experts. Each year EDI members gather at the EDI Leadership Summit to learn, teach and collaborate on emerging issues in law and technology – with a focus on discovery, information governance, cybersecurity, litigation and big data management.

This year, the EDI Summit 2024 is at the Marriott Harbor Beach Resort & Spa in Fort Lauderdale, FL. After a Welcome Reception last night, the event will include two days of educational sessions and activities. The Summit Agenda-at-a-Glance is here.

Caselaw Update (Ocean Ballroom)

There has been a large volume of caselaw in the wake of the changes implemented under the most recent amendments to the Federal Rules of Civil Procedure (FRCP). It is worthwhile for practitioners to understand the highlights and potential pitfalls in discovery jurisprudence. This panel, now a Summit tradition, includes leading experts who will provide a critical update and discuss the current state of the union as it relates to discovery.

Can Generative AI Solve Your Privilege Pain Points? (Salon V)

As our industry explores emerging use cases of generative artificial intelligence (GenAI), one burning question is whether GenAI can help solve the complex and challenging tasks surrounding privilege identification and logging. This panel of industry experts will discuss the current state of GenAI, including results from recent tests of GenAI’s ability to handle privilege coding, logging and other considerations. Panelists will also explore when and how litigants can integrate GenAI into cross-matter privilege strategies.

The Annual Judges’ Panel (Ocean Ballroom)

This year, the Judges’ Panel will focus on a hypothetical case in which the parties utilized AI to help prepare pleadings, discovery requests, responses and briefs, summaries of key documents and testimony, and chronologies and timelines – to mixed results. The Judges will provide their perspective on key issues that AI is raising in litigation, such as the impact of AI efficiencies on proportionality arguments, the permissibility of AI review of documents for relevance, privilege waiver from the use of client information to train AI and the consequences of bias in AI.

Navigating the New Frontier: Addressing AI-Induced Risks in eDiscovery (Salon V)

As AI becomes increasingly integrated into the discovery process, legal practitioners face new and complex risks. This panel will focus on the specific challenges and considerations essential for managing these risks effectively. The discussion will include: the importance of understanding how AI impacts data protection and confidentiality and provide specific strategies for safeguarding sensitive information, evaluating the processes used to validate the results generated by AI discovery tools and determining what level of transparency (if any) should be required when a party employs such tools.

Navigating Microsoft 365 & Purview in Your Organization (Ocean Ballroom)

“It’s called Copilot, not Autopilot” was one of the prevailing takeaways during the 2024 EDI Summer Meeting at Microsoft’s campus in Redmond, WA. Join this panel to learn more about the new Purview user interface, key feature updates in Microsoft 365 and how Copilot integration affects the entire Office ecosystem. Discussions will feature boots on the ground perspectives for corporate legal departments and how they should investigate when I.T. decides to roll out Microsoft Copilot within the company – with a particular focus on the areas of compliance, data privacy and potential legal liabilities.
