Freedom of Choice with Brian Kelley of CloudNine on the Technocat Podcast: eDiscovery Trends

Do you need freedom of choice in deployment options of eDiscovery software? Brian Kelley and CloudNine say “yes” and they’re doing something about it!

Brian, who is VP of Product at CloudNine (and my former colleague), sat down with Cat Casey on her Technocat podcast recently. As CloudNine announced last December, they are releasing an on-premise version of their popular SaaS product, CloudNine Review, in 2026.

The move is driven by specific market demands and the withdrawal of other on-premise products from the marketplace. Strategic drivers for on-premise adoption include:

  • Cost Control: Organizations can manage data volumes in-house to avoid unexpected billing spikes associated with third-party hosting.
  • Data Security: On-premises deployment addresses concerns regarding data sovereignty and the security of sensitive information by keeping it within the organization’s firewall.
  • Process Management: Organizations can control their own workflows and backend data access without relying on external providers or navigating conflict-of-interest checks.

Among other topics, Brian also discussed a core technical differentiator for CloudNine, which is its sophisticated handling of “modern data” (i.e., non-traditional communication sources such as Slack, Teams, and encrypted messaging apps). By processing data at the individual message level rather than through broad 24-hour threading, the platform enables more granular deduplication, more defensible privilege logs, and more efficient review of complex group communications.

Modern data is a “don’t get me started” topic for me – it continues to be one of the biggest challenges for eDiscovery professionals. The ability to handle it in a sophisticated manner is a “must have” for eDiscovery professionals.
