Level Legal’s Matt Mahon was on the latest episode of That Tech Pod discussing the future of eDiscovery. Here are some highlights.
The episode is titled The Future of eDiscovery: AI, Digital Evidence, and What’s Next with Level Legal’s Matt Mahon (available here), and Matt sits down with co-hosts Laura Milstein and Kevin Albert to discuss how courts are increasingly permitting the use of GenAI provided there are rigorous safeguards, documentation, and validation protocols in place.
They also discuss how cost savings related to the use of GenAI remain elusive for many due to a significant gap in technical expertise and the inherent costs of backend technology, how the industry is moving away from traditional billable hours toward alternative fee arrangements (AFAs) and flat-rate pricing, driven by a need for greater transparency and collaboration, and how legal teams must expand their scope to nontraditional data sources when identifying potential data sources to avoid missing critical evidence in discovery.
One notable source of nontraditional data that Matt mentioned that doesn’t get discussed enough is gaming platforms like Xbox and Roblox, which are increasingly used for digital communication. Great point.
