It’s the final countdown! 🙂 The International Legal Technology Association’s (ILTA) annual conference ILTACON 2023 is concluding today. We’ve already had several interesting sessions on Monday, Tuesday and Wednesday! Here are the ILTACON 2023 Thursday sessions and happenings, including one at which I’m speaking!

Each day at ILTACON 2023, eDiscovery Today has been highlighting notable sessions for the day – in most cases, those sessions will relate to eDiscovery, Information Governance, cybersecurity, data privacy, or artificial intelligence (as well as a few other happenings during the week). Ignorance is not bliss–it’s potential liability (Deeper Dive): Decision-making during a cyber incident (Y&B Convention Center, Newport Ballroom West)

This workshop confronts the consequences of critical business decisions made during cyber incidents. Experts will moderate this interactive workshop, cybersecurity experts and legal advisors will guide attendees through several real-life incidents to explore how the critical decisions we make during cyber incidents makes the difference between controlled events or ones that lead to business altering situations. The workshop offers attendees the opportunity to hone their skills in an environment that not only simulates a cyberattack, but the competing interests in the boardroom, and often chaotic and volatile atmosphere permeating these critical business incidents.

Litigation Support Roundtable: The Privilege and Publicity Edition (Y&B Convention Center, Newport Ballroom East)

This ILTACON tradition continues with a new twist for 2023, The Privilege and Publicity Edition. Continuing the discussion from last year’s Litigation Support Roundtable: The International Edition, this year’s gathering of technologists, paralegals, and lawyers will examine how litigation technology professionals can work through the often thorny issues related to the attorney-client privilege and the work product doctrine—especially in high-profile matters with a great deal of publicity.  We’ll have the litigation support director in Carroll v. Trump discussing his experience supporting that case as well as a special video appearance by Justice Tanya R. Kennedy on the effects of privilege and publicity.  We’ll also look at high-profile case law in matters involving Elon Musk and Marvel Comics, and get your thoughts on issues such as:

  • What do you do with your privilege log when your data indicate a custodian communicated with her personal lawyer on work email?  
  • How do you handle data reproduction after a clawback?  
  • What about casual chats on Slack and other platforms that comingle business strategy and legal advice?  
  • Are emojis and emoticons an issue?  

We’ll learn about recent case law on these topics, and what makes the Litigation Support Roundtable special is that it’s your opportunity to take the mic and share your experience while learning from your friends and colleagues. Psychology 101: Understanding the Psychology of Cyber Incidents (Y&B Convention Center, Newport Ballroom East)

In a cyber crisis, who makes the decisions: The senior person? The technical expert? The self-appointed hero?  In crisis leadership, removing the emotion is critical. Yet our human biases, office politics and perceived personal fears often influence or delay sound decision-making. In this session, we consider a select list of common cyber crisis characters, explore human bias, and consider leadership and learning models to help navigate the pitfalls of the human element in cyber incidents.
