#15: Hyperlinked Documents and Email Threading Disputes Addressed by Court: eDiscovery Case Law – The only case law post that cracked the top 15 and it barely made it! Hmmm…was there an overriding trend this year which dominated the headlines? 😉 This ruling has continued the hyperlinked files as modern attachments debate, which is still going strong! More to come.
#14: Microsoft Loop Considerations for eDiscovery and Compliance: eDiscovery Best Practices – The popularity of this post would have “thrown me for a loop” (see what I did there?) except for the highly unique topic and excellent coverage by Damir Kahvedžić, Ph.D. and Ryan Hemmel of ProSearch!
#13: Employees Are Feeding Sensitive Data to ChatGPT: Artificial Intelligence Trends – Posts mentioning ChatGPT made the top 15? No way! 😀 This one was early in the year when people were “jumping into the pool” of ChatGPT without a life preserver (i.e., not knowing what they were doing). Kind of like they are now. 😉
#12: Hyperlinked Files as Modern Attachments – The Case Law: eDiscovery Issues – This was the first post in the series of posts related to this topic (see #15 above) and it got a lot of play not just here, but also on LinkedIn. eDiscovery people have strong feelings on both sides of this issue.
#11: Google Search and Apple Watch Data May Disrupt Criminal Case: eDiscovery Trends – The one “true crime” story to crack the top 15 this year. It was covered by People here, and I’m pretty sure it’s been covered by 48 Hours and other true crime TV shows too.
#10: Lawyer’s Social Media Posts Wipe Out $1.5 Million Verdict: Litigation Trends – If you feel like posting on social media about the trial before the verdict, don’t be surprised if the Court awards a new trial, feeling that the jury has been potentially ”tainted”. Whoops.
#9: 12 Legal Use Cases for Generative AI Infographic!: Legal Tech Trends – Infographics are popular – especially when they combine generative AI with how to use it for legal use cases! Thanks to LTMG for the graphics work!
#8: Insurer Sent Law Firms a ChatGPT Warning: Artificial Intelligence Trends – Insurers don’t think that ChatGPT is ready for prime time! Or at least didn’t back in April, which is like a lifetime in generative AI terms.
#7: Colorado Lawyer Suspended for a Year for Fake ChatGPT Citations: Artificial Intelligence Trends – Wow, this made the top 15 and the Mata v. Avianca case didn’t! I guess I had you all at “suspended for a year”! 😮
#6: ChatGPT Makes Things Up When It Doesn’t Know the Answer: Artificial Intelligence Trends – This was back when we were just getting to know ChatGPT and what “hallucinations” are, and ChatGPT thought I was “the founder and CEO of Eagle Discovery”, “the author of several books on e-discovery” and “been teaching e-discovery courses at University of California, Berkeley since 2000”. I’m having ChatGPT write all my résumés from now on! 😀
#5: Gates Dogfish Keeps Us eDiscovery Nerds Laughing!: eDiscovery Humor – When I “interviewed” Gates back at the beginning of the year, nobody knew who he was (including me). Nearly a year later, we all know who he is now! Pains me to admit this, but he’s the funniest guy in eDiscovery! 🙂
#4: 2023 State of the Industry Report is Now Available! Here’s How to Get It: eDiscovery Trends – Déjà vu all over again! The 2022 report was #4 last year too! Sure, it had most of the year to gain views, but it’s still gratifying to see how popular the State of the Industry report has become! Look for the 2024 edition next month!
#3: eDiscovery Events in 2023, Here’s Your Running List So Far!: eDiscovery Trends – Yes, it’s always the first post of the year, so it has all year to collect views, but it’s damn useful and Rob Robinson of ComplexDiscovery does a great job of keeping it up to date all year!
#2: 120 Mind Blowing AI Tools: Artificial Intelligence Trends – I still don’t know who originated this infographic, but it’s terrific and it has continued to pile up views since I covered it in July via a Twitt,er, X share from Tom O’Connor.
#1: 2023 Internet Minute Infographic, by eDiscovery Today and LTMG!: eDiscovery Trends – Have I mentioned lately how much I like an infographic? After I couldn’t find a good infographic on what happens in an average minute on the internet last year, I decided to make one myself this year – with the wonderful graphics help of the team at LTMG! Can’t wait to do it again in 2024!
