Time for another thought leader interview on eDiscovery Today! This time, I’m interviewing Krystal Putman-Garcia of Casepoint!

Krystal is the Chief Marketing & Strategy Officer at Casepoint. The purpose of the interview with Krystal was to discuss the just released report from Casepoint titled: From AI Hype to AI Accountability: What You Can Learn From Legal and FOIA Teams About AI Modernization (available here, covered by me here). For the report, Casepoint interviewed dozens of senior practitioners across corporate legal departments, federal agencies, and law firms about how AI is being used in legal, FOIA, records, IT, and compliance work today and the report turns those conversations into practical guidance for building AI workflows that can be verified, explained, and defended.

Among the topics I covered with Krystal: the inspiration for Casepoint to produce this report, and why they felt now was the right time to shift the conversation from AI hype to AI accountability, findings from the interviews with practitioners from law firms, corporate legal departments, and federal agencies that surprised Krystal the most, how organizations should build verification into their day-to-day legal workflows rather than treating it as an afterthought, and why Krystal and Casepoint believe records management will become one of the biggest AI governance challenges over the next few years.

We also discussed how one federal eDiscovery practitioner raised the concern about defensibility in court for GenAI, comparing it with TAR 2.0 and what it will take to overcome those concerns, whether Krystal sees GenAI following a similar path toward judicial acceptance that TAR did, unique AI challenges which government organizations face that private-sector legal departments may not fully appreciate, how government agencies minimize the impact of AI enabling requesters to generate many more FOIA requests and more!
